Trademark Registration

Having your trademark registered keeps other people from stealing and using your name and logo for financial gain. Trademarks are a graphical depiction of a mark that can be used to distinguish one person's goods and services from those of another. Shape, color, or combination of colors of the product or container may all be relevant here. You must register your trademark in India if you want to safeguard the good name of your business. In essence, it's everything that a regular customer would identify with a certain brand. A "mark" could be anything—a gadget, a label, a heading, a ticket, or a brand. Using a name or signature is an example of a "mark."

Currently overseeing the Trade Marks Act, 1999 and its regulations, the Trade Marks Registry was founded in India in 1940. In addition, Indian trademark organizations provide as a clearinghouse for resources and information on trademark-related issues.

In a given logo, "SM" denotes a service mark and "TM" denotes a trademark. The employment of service mark and trademark symbols alerts the public to the company's claim to exclusive trademark ownership. Only those who have submitted a trademark application are permitted to use it.

An individual may use © on a trademark when it has been registered with the Trademark Authority and published in the official gazette.
